Canadian Passport Applications and Criminal Records + Charges + Offences



Ever since a reader and I had a bit of a debate as to whether a criminal record could delay one's application for a passport in my Online Passport Application Article , I've gotten a few hits every day from people asking this very question. I stated that I thought that a criminal record could delay one's application, while this user claimed that I had no idea what I was talking about. So, this made me curious.

2010 Update: I've written a clearer and everyday explanation of who can't get a Canadian Passport. I recommend reading this link first, then come back here to read it and the comments (there are several pages of comments!).

Of course, every case is going to be different, and I'm not even going to get into how this might affect one's ability to get _into_ another country. I'm going to only address applying for and getting a Canadian Passport.

Canadian Passport Laws/Regulations re: Criminal Records&Related Stuff

From the Canadian Passport Order, Section 9 (retrieved December 21st, 2007):

9. Passport Canada may refuse to issue a passport to an applicant who

(a) fails to provide the Passport Office with a duly completed application for a passport or with the information and material that is required or requested

(i) in the application for a passport, or

(ii) pursuant to section 8;

(b) stands charged in Canada with the commission of an indictable offence;

(c) stands charged outside Canada with the commission of any offence that would, if committed in Canada, constitute an indictable offence;

(d) is subject to a term of imprisonment in Canada or is forbidden to leave Canada or the territorial jurisdiction of a Canadian court by conditions imposed with respect to

(i) any temporary absence, work release, parole, statutory release or other similar regime of absence or release from a penitentiary or prison or any other place of confinement granted under the Corrections and Conditional Release Act, the Prisons and Reformatories Act or any law made in Canada that contains similar release provisions,

(ii) any alternative measures, judicial interim release, release from custody, conditional sentence order or probation order granted under the Criminal Code or any law made in Canada that contains similar release provisions, or

(iii) any absence without escort from a penitentiary or prison granted under any law made in Canada;

(d.1) is subject to a term of imprisonment outside Canada or is forbidden to leave a foreign state or the territorial jurisdiction of a foreign court by conditions imposed with respect to any custodial release provisions that are comparable to those set out in subparagraphs (d)(i) to (iii);

(e) has been convicted of an offence under section 57 of the Criminal Code or has been convicted in a foreign state of an offence that would, if committed in Canada, constitute an offence under section 57 of the Criminal Code;

(f) is indebted to the Crown for expenses related to repatriation to Canada or for other consular financial assistance provided abroad at his request by the Government of Canada; or

(g) has been issued a passport that has not expired and has not been revoked.

So, that's (part of) the law on the subject.

Section 57 of the Criminal Code of Canada relates to crimes regarding the forgery of passports and misuse of passports.

Here are the laws/regulations on "Revocation" (ie: taking away one's passport that they already have).

I am not a lawyer, this isn't real legal advice and I haven't had any experience with this, so your mileage may vary.

Layover in US.

I can't seem to get an answer anywhere so hoping someone here can tell me finally and FOR SURE.
Facts - My planned flight to Belize has a US stopover. (I can't find a direct flight) I have a Pardon but I got it several years after being turned back at he border once for a planned day trip. Fingerprinted, the whole bit so they do have a copy of my old record. I am of course now considered inadmissible to the USA
Q - Will I be denied "ENTRY" at the US stopover? In General, how will this affect my trip?

Hi, is there anyone with similar situation as mine out-here? Let me explain my situation a little bit. I have a permanent Residence from the U.S.A. I married and Canadian Citizen and My wife made an application to sponsor me back in 2012.July 10,2014, we had had our interview, Immigration Canada had requested my FBI record from the United States but I had not received by the interview date, they asked to send it to Immigration Canada when I received it. I just Received the FBI Report and its showing a charge of Illegal Entry from back in 1983, I was using a different name but I was using my picture on the my passport.during the war back in 1983 in El Salvador I a lot people travel using different documents, I am not trying to excuse my offense, I am just trying to explain my situation. I was charged but I did not do jail time, I was out and when I applied for Immigration papers in the U.S I used my real name. Anyways, now I don't know how Canada Immigration works with such felony, are they going to refuse me? do I get a pardon before sending them my FBI Report? is there someone with similar situation any advise that anyone can help? I will appreciate it any help.

I have a pending case here in the states. I got caught shoplifting. The charge is the smalles you could have, as it is a level 3 retail fraud (under $200). I have had a trip planned to canada for a while now and it's this weekend, and I haven't fine to court yet. I believe I have oending charges, would I have a problem crossing?

Thinking about a vacation but have a crininal past

Back in '94 I had a dangerous driving charge and conviction in '95. I plead guilty, as it was completely my fault, had the judge saying in court that it was a pleasure to read a presentence report like mine, and received a probation. I did something completely out of character, but I did it and paid the price.
Now to my question......
I know I need to have a pardon before I can apply for a passport, but do you need a passport to go to Cuba? Can I go to Cuba with my dangerous driving conviction.

Crossing Into USA With A Police Clearance

Hi, I was charged in 1997 with Possession of Property Obtained by Crime. I now have a Passport and Pardon. I was refused entry to the USA before the Pardon, so I applied and received a US Entry Waiver for 2 years in a row and stopped because of financial issues. I was recently speaking with someone who has a similar situation and he told me that all he does, is keep an updated Police Clearance with him and he crosses the border and shows the Clearance and his Passport and it's accepted.

I would like to get a Canadian Passport and travel with my young family, however am concerned about some things I have read lately.

I was charged and plead guilty to a theft charge (it was under $100) and did 1-3 months of probation only...details are fuzzy as it was about 16 years ago. I am now 37 and have not had a problem since, not even a speeding ticket.

First Question: Is this considered a Criminal Record?

Will I be denied a Canadian Passport?

Will I be able to travel with my Husband and young child to places like Florida?

No worries.

No you need not worry. Get your passport no problem. Go to Florida. Don't admit to anything, you are not the same girl it must be another person with the same name... It will never eve come up. Go do what ever and forget about that.

Charged, NEVER convicted ... can I get permanent residency?

I lived in a 3rd world country for a few years and ran into some problems with corrupt officials. I had no problems leaving and relocating to Canada but found out that almost a year AFTER I left this 3rd world sh*thole that they supposedly charged me with money laundering for simply taking my own funds from my own bank account out of their crappy little country.

Anyways I am now living in Canada with my husband and am in the second step of the permanent residency process. Will I be approved or could they consider me inadmissable because some corrupt idiots from a 3rd world country "charged" me a year after I left their sand pit with money laundering?

Failure to appear for driving while suspended

I was charged with driving while under suspension and didn't show to the court date (financial reasons and we lost our house, didn't get the notice). Theft/Fraud under 5K- Traveling to the U.S

I have a question regarding this as well. ANY HELP would be much appreciated. I have no idea who to ask. I was charged with theft/fraud under 5K when I was 18 (about 5 years ago). I was younger and stupid for doing it. There were 3 people involved including myself but fortunately MY charges were WITHDRAWN. I applied to get my fingerprints destroyed and it was approved so the RCMP sent my fingerprints and photographs as well I believe to the local police station where it was destroyed.

I have not been to the U.S since this happened or even after the fingerprints were destroyed however I am traveling to the U.S through the Niagara Falls Border in about a month with some friends and family for a wedding. I want to know if this will pop up at the border or will I be asked anything because I don't want this being asked in front of my family and friends.

Is this dependent upon which officer I encounter or is it guaranteed that I will NOT be asked because my charges were withdrawn and my fingerprints were destroyed.

Back in January I went through the diversion program for theft under 5k, I am a student who crosses the border at least 3 times per week so I could not avoid the border until my fingerprints were erased from the system. Last week (April) I was pulled into secondary inspection where they questioned me about my charge. I answered them honestly and explained as best as I understood it. Luckily, they let me through to school that day but requested upon my next crossing that I bring the certified court documents. I just did that, had my F-1 Visa stamped and I am ready to start a new term. However my Nexus card was temporarily taken away from me as the officer was sure I was convicted of a crime. I explained as calmly as I could I wasn't and but she was judging. The other officer photocopied my court documents and said they would take this up with their superior (who knows what that really means). I have written to my local police chief (2 wees ago) and I am awaiting a response with regards to the removal of my fingerprints and photograph. I understand they not only remove this from the RCMP system but also from the FBI system which also may mean the US Homeland security system? -That is my question -will this be removed from Homeland -is there a way to get it removed from Homeland or does it forever remain in Homeland? I will be consulting with a US immigration lawyer as well but thought I would ask you first :) Thank you.

I attach the term "arrest" with handcuffs, riding in the back of a police car, jail, bail, and pleas of either guilty or not guilty. Instead of this, I was given a ticket to appear for fingerprinting and a court date then I walked out and drove home -there was no plea, no conviction, and no lawyer.

From what I have heard. they will always be able to see it. My friend who was charged when she was 18 for shoplifting(she is now 45) was held up on her way to Hawaii. She just made her plane by minutes. She was never bothered by this before but they are checking everyone now. You will likely need a US enter Waiver.

Criminal Record.

Please help, my boyfriend was last arrested about 8 years ago, once he went to court the judge dropped the case (Actually, he told the "victim" to stop lying and walked out)
This was his last charge, previous charges were assult, and B&E. But it was more than 10 years ago. Can he cross the border into the US without a pardon? He's never attempted to leave Canada before in his life, but he did get a police check done about 4 years ago, and it was very limited on what is on it (we noticed alot of things weren't even on there anymore, they said it was because it was from so long ago, or something)
Just curious to see if he'd have an issue getting into the states, or returning to Canada.

I used to get into petty trouble as a youth, theft, 1 assault for spitting :S and breeches and warrents.... i am going to be 20 years old in april, i hadnt gotten into trouble as a youth after i was 16. When i turned 18, me and a friend when we were drunk, took some girls purses, got charged with robbery... i went straight to jail... It was eventually dropped to theft, then the charge was dropped completly.... during the time i was on prohbation for that charge and awaiting for my court date, i breeched. I have served my time for my breech and i have no new charges... the only charge on my adult record was the theft wich has been withdrawn... but there is still the breech... I really want to travel and go to the US and all over... can you tell me what route i should take and if i could gain access to the US?!

Drug charges in the US

I have outstanding drug charges in the US went to court for about 6 months and once I was told there were going to fry me I never went back approx. 7 yrs ago is there a statute of limitations on that. The US doesn't consider a DUI a serious crime, so you should be fine. It's a bigger problem for Americans with DUIs that want to come to Canada and we make a big deal about it. Who knows about El Salvador.

Finding out about outstanding warrents

Many years ago, my son was charged with theft
over 5000. He was put in jail o/n, it scared him, couldn't get
any info from lawyer. He got worried and he left Canada about
a year later, (I never heard mention of a court date)
This was when he ws 20. Now 9 years later, he would like
to clear things up but before heading back, would like
to find out if he was found guilty (never heard from the lawyer)

Canadian Citizenship

Hi, I have been living in Canada for 11 yrs and also got married to a Canadian National in Oct 2011. Recently we both visited India and to my horror I was told that the validity of my passport was fake as it expired in 2006 and it was tamperd and rewritten as vaild from 2006 to 2016. This was done by the Indian consular office for some unknown reasons ,and I am innocent. We have appealed in court that having a high profile job and when I am entittled to get it renewed ,Why should I tamper my own passport. the case is still in progress. Meanwhile ,after the case is settled with payment of fine , will I be able to get a Canadian Visa , as I do not have clean record in Canada, working in a high profile job and moreover I am married to a Canadian national .I also have a Permanent Residence status.

I have a Canadian pardon for theft under $5000 and applid for and received my passport a year or more after the pardon was granted. I used to travel to the US before my conviction (conditional sentence) and haven't been back since, so have never been denied entry. Wondering if I should get an entry waiver just to be safe, or hope that nothing shows up on my passport at the border. Just want to drive across to do some shopping. Thoughts?

Officially, the US doesn't

Officially, the US doesn't recognize Canadian pardons, once a convict, always a convict, then requiring a waiver of sorts.
If your pardon has gone through, and you haven't visited the US since before being charged, the US should be unable to see that you ever had a record if they pull your records from Canada. They only pull records when you try to cross, not in the intervening months/years. If the US border asked you if you've ever been arrested/fingerprinted/charged/convicted/etc, and you said "no", they would have no proof that you were lying if you received a pardon. If you ever answer "yes", and they document what you say, they'll permanently store what you said in their records, and you could be denied entry and require an entry waiver forever (unless you fall under the petty-offence exemption). You have to apply for a waiver, they're not permanent, and not everyone qualifies for one.
Get a copy of your records from your police station just to make sure there are no records on the Canadian side.

Read the other comments here and info on the web. Getting a consultation with an immigration lawyer would be the best idea and not be that expensive.

OK I have a family member that will be flying with me into the USA next week, and he got a Pardon which was granted 12 years ago (in 2000). Also the Crimes were done back in 1984/1985

From what we have read online that if the Pardon was obtained and the person has never attempted to enter the USA before the pardon was obtained that the USA wont have their information in the file because Canada would have already sealed the information 12 years ago.

Once you are inthe United States Homeland Security's system, you then are in the FBI's system and any pardon is not recognized by the US government. Best advise is to continue applying for the US entry waiver.

My boyfriend, who is a Canadian citizen and has a criminal record including theft, assault and failure to appear, was able to obtain a Canadian passport last year and on a whim, we hopped a plane to Mexico for Christmas. We did not encounter any issues whatsoever upon entering or exiting both Mexico and Canada. However, be sure you do get a direct flight, as I understand stopping in the USA with a criminal record will cause you all sorts of grief, though I have no idea just how much or of what kind. Plead Guilty in the UK

My fiancée was accused of stealing a 20quid phone from his (no longer) friend's market stall. He was recently taken to court (Jan 10th, 2012), where his solicitor did not show up and the barrister told him to plead guilty because if he plead innocent and was found guilty he could be sent to prison. So, even though he didn't do it he plead guilty and was given 100hrs + 6months of of community service. This is really crappy timing, as we were in the process of applying for him to come live with me in Canada and gain a work visa. Is it possible to have his charge pardoned in the UK for him to come to Canada, as it was a minor and first time offence? How do you/what is the best way to gain a pardon or remove a criminal record obtained in the UK? a no entry list probably called something dumb. Once charged you must obtain one of the following before attempting entry a US waiver or Full pardon of your crime. Small amount of weed crossing into the US

My friend was travelling into the states from canada and when they searched his car found .04grams of weed. He got charged and fingerprinted and all that, posted bail and headed back to Canada. A week later the bail money was sent back and the charges were dropped. If you are a canadian citizen, you have the "RIGHT" to re-enter the country. this is YOUR country of citizenship whether you were an ex-convict or not.

the question is, since you do have a federal criminal record in canada, will your country of origin "allow" you to enter in that country? remember even if it was your country of origin, once you present a "canadian" passport, you are a FOREIGNER to that country of origin of yours. you may want to present the passport of your country of origin when you enter it.

Can anyone tell me if when driving across the border (into the US from Canada) and your passport is scanned, does it automatically perform a CPIC or does the agent at customs actually have to perform another process to do this? I think its up to the agent who they run the CPIC on but I want to make sure so I'm not assuming anything.

One is considered as a crime of moral torpitude (for which one is inadmissible and should apply for a visa waiver) while the other is an exception under the "petty crimes" clause of the INA and they should allow you through at the border even if they know about it. I have been stopped at the border before and brought inside and checked. They asked me questions about my pass arrest, I told them the truth, that I was arrested but never convicted. I dated someone and my name came up as an associated with this person. The charges were dropped. They allowed me to enter after a short question period.

I am a Canadian citizen and have a warrant for my arrest but i have not been charged and my warrant is for fraud. If there is a warrent, you have been charged with a crime you just haven't appeared to face those charges. My husband is currently facing a similar situation. While out of the country his ex girlfriend was served with court papers for him to appear in court. He never received the notice personally and failed to appear which resulted in a warrent. It is my understanding that the RCMP officer in charge of the case told the judge that he was out of the country so the judge revoked his passport for being charged with an indictable offence and not appearing to answer those charges. There is a very real possibility that the second you attempt to enter Canada you will be arrested. Do yourself a favor and have a background check run on yourself and check your passport status before you just travel back to Canada. If nothing shows up then take your chances if it does then you should probably make the decidion to either stay where you are or go home and face the charges.

You should still be able to get a passport as long as you have fulfilled your court obligations. Getting into another country may be another story, so do your research _before_ planning any trips outside of Canada.

Friend from the States

I have a cousin who is living in the states for years. Everytime he comes up to Canada for a visit and leaves he is always pulled aside with the USA immigration. Always. He has a hit on his record from 7 years ago, something to do with not renewing his visa. He is almost a US citizen at this point. It's just odd to constantly being red flagged. Is this normal ? I'm afraid to travel with him because he's always pulled aside when re-entering the US and always let go. Is there a way to check his record out online and will it ever go away?

a red flag is always there unless you take steps to have it removed - not sure how - or even if they will remove that from his records.

There is probably a notation on his file regarding the Visa issue. If he is released each time it sounds as though it has been resolved by his citizenship application. It should straighten itself out when he obtains his citizenship.I wouldn't be worried about his this extra scrutiny unless you have something to hide. Otherwise its just a minor delay and won't affect your travel status in anyway in the future.

It's just weird that every time (and I mean it every time) he re-enters, the US custom agents always pulls him aside, they take him to another room, some manager comes in to to check up, he's held up and questioned for 15 min but is always let go at the end. I just find it weird that this notation is causing all this to occur. I'm sometimes curious to know if I can actually find out what is written on his record, because maybe it's more (criminal). He told me he's going to be qualified to apply for his citizenship soon. But this whole notation is just because of not renewing his visa a very long time ago. I'm skeptical but maybe I should be. Probably a bad idea while the charges are still in process. I believe the charge gets dropped after a period of good behaviour, or after you complete your community service/fine. It's possible that the US may not recognize this, but do a criminal record check on yourself once everything is sorted out, and if it comes back clean, you could answer "no" if asked if you've been charged/convicted, and possibly even if you've been arrested. If you try to visit the US while there's a "hit" on your record check, they'll store a copy of this in their database, and you'll -forever- be stuck having to get waivers/visas, which could be very difficult depending on what you were possessing.

Notice of Conviction Outstanding Parking Tickets for Calgary

I'm flying to New York in a few weeks and I have parking tickets that I've received notice of conviction for. What will happen if I don't pay these before I leave? I'm planning on clearing them up on pay day but I think that now, when you try to re-enter Canada, you can be arrested? I think this happened to my friend's son when they flew home from a family vacation in Hawaii. His Dad had to pay the fines on the spot. Does this apply to parking tickets now - probably, if I've received notice of conviction. GEESH :S

Unpaid Parking Tickets and Travelling

I'm assuming that these are Canadian parking tickets, and you're a Canadian citizen. I don't think CBSA will care about your parking tickets. I don't think they'd care about it unless you've had a pattern of unpaid tickets over years and years, which I doubt is the case if you're able to pay them off at pay day. A Notice of Conviction for Parking tickets isn't as serious as some others :)

I went to court for driving with a suspended drivers license and they gave me fines and 2 years probation .. meaning being caught with any like charges again will result in jail time. This was one year ago. I have a valid passport. Am I still able to travel to Dominican Republic or Mexico for a vacation this year?? Thank you.

PASSPORT IS THE LAST WORRY

Most of you worry about the Passport being issued to you or NOT. Let's get our priorities straight.

When you apply for a Passport in Canada, it is $225 for an electronic "e-Passport".

Why would the government refuse $225? Why would they care where you go if you are an ex-convict? Or you paid your debts to society?

Say you got your PASSPORT. Nice. Now what? You think you can enter the US with some sort of a criminal record? Or England? It is not the PASSPORT that matters. It is YOUR DESTINATION. There are TONS of people with passports but are RENDERED useless because their country of destination refuses their entry. You know why? Because the government which has issued you a PASSPORT that you paid $225 for contains all your PERSONAL records attached to it electronically INCLUDING your criminal records. They are just DOING their jobs. I believe you have the right to a passport, what you dont have the RIGHT of is entering any country - THAT is a priviledge that can be DENIED.

Get your priorities straight. Getting a passport is 1/4 of the battle. The other 3/4 is being able to ENTER the country of destination.

IMPORTANT

A non-conviction disposition does not mean that your records will be erased automatically. What you need to do before you cross the border is to make sure that all your files are purged.

1. Request the arresting local police to ask the RCMP to return the fingerprintsand mug shots to them for destruction.
2. Request the local police for a clearance letter and keep that as a back up record (or bring it with you when you cross for the first time just in case)

Pending Charges

My fiance and I are getting married in 3 weeks in the US. It has been planned for the last year. He recently was in an altercation and was charged with asssault causing bodily harm. He was also fingerprinted. The Crown has decided to charge him by way of summary conviction because it is his first offense. The case is still pending and has been pushed back a couple months. We could not cancel our Wedding or we lose all the money we paid for it. Question is, will he have trouble when we get to the airport and go through customs? Is there a chance they wont check, or wont see this charge? If we have a document stating it is a summary charge, is it possible he will get through?

Mistaken identity/Warrant for arrest

Hello, I am a Canadian and recently went to the US in April. I went down to Las Vegas/ California for 10 days with 3 of my friends and enjoyed my holiday. (Entered the US with no problems). When entering back into Canada I was taken into the Canada Border Agency and told there was an outstanding warrant for my arrest for 3 charges in 1999. Take auto without owners consent, Possesion of stolen property over $5000 and drive impaired. Now I have no crimminal record whatsoever, have a clear drivers abstract. I have never been arrested but was told I was being placed under arrest for these charges. I was issued a paper from the police for a promise to appear in court in June. Which I went to. I had to go to the police station and get my photo taken and get fingerprinted. Did so then went to court and talked to the crown attorney which told me I was not on the docket (not sure if that is spelled correctly) for that day. So, I was told to go back to the police station where I assume the did a crimminal background check on me, then told me to go back to the court and they'd see if they could get me in for that day. During the court break the officer talked to the crown attorney and he told me to go home and they'd investigate it further. (The officer said to me someone probably took your identity). I have not heard from them since. I also flew to Las Vegas the previous 2 years and got back into Canada no problem. (Also was issued a Canadian Passport no problem). The warrant has my name,drivers liscence and DOB but from a different town. (Which I have never resided in ever). Now I know this is not me and believe someone used my identity for these offences. My question is I want to go back to the U.S. in December. Will I be denied entry because of this? I don't want to spend money on this if I am going to be denied entry. Any info on this would be greatly appreciated. Thanks!!!!

I would recommend going to your local police station and getting a criminal record check to see what comes back. If there is stuff on there about these offences, it could create a problem when going to the US, as they can look up CPIC. The US side has an even less likely chance of believing you or being able to investigate further.

It is very curious that you had no problem getting a passport, but when they looked into it later, a warrant showed up, so it sounds like the warrant exists in some systems, but not others? I don't know how it's configured on the government's end, but it's probably a big mess. Maybe they were nice and put an asterisk on your profile, or maybe they "fixed" it by making sure it existed on the other systems until you fixed it.

You'll need to press the police to correct this record. The fingerprints should've come back different from whomever was arrested back then. As I said, you'll need to pressure them to correct their error. It would be nice to have some pieces of paper saying your criminal record check and all that came back negative. Be sure to get everything in writing from everyone that you talk to, and if they won't give you anything in writing, make your own written notes of who you talked to and what they said, your evidence will be better than their's.

It also depends on how common your name is, although if they had your Driver's License number, it sounds like an identity theft thing.

Keep us updated, as you're likely not the only person with this type of situation.

I'm sure a criminal lawyer could solve the problem quickly, but it would come at a price. If you only need to go to the US again in December, I'd say see how far you can get doing things yourself, 5 months _should_ be enough time to get this sorted out.

Applied for a pardon a year

Applied for a pardon a year ago for assault and fraud charges. Completed all payments and fingerprinting etc. Pardons Canada informed me that my Pardon does not kick in till February 2012.
Would like to travel to Vegas for an upcoming UFC event. Is it safer to travel from YVR to Vegas or drive to Bellingham and fly to Vegas without hassle? Please advise.

here's my scoop:

The United States Homeland Security and Immigration do not recognize Canadian Pardons, to them, YOU are still an ex-convict. However, since the conviction is 'sealed', your records may or may not show in their system. BUT, if they ask, have you ever been 'arrested or charged' that lead to a conviction, what would you say? if you say yes, you have admitted to being an ex-convict, which will cause them to deny you.

if you say NO, what if they have some access to your history and sees that you have a conviction (some of them already know, they just wanna hear it from you if you were lying or telling the truth), then you have lied to them and it is considered "fraud" which will cause them to deny you.

you have one shot in trying. the judgment and decision to cross is in your hands.

The flight from Bellingham to Vegas is probably cheaper, so if something goes awry, you're out less money. I think YVR pre-clears, so they'd stop you in Vancouver, not Vegas (most likely). It's chancey, because once you're in the US system as someone that has a record, your pardon doesn't matter, the US doesn't recognize it and you'll forever need to apply for a waiver, even with your pardon in hand.

My husband and I are seperated, but we have two children. We both travel a lot for hockey for the kids. My question is: If we fill them out as married, will this affect my ctb with cra, will they check this with the cra & are they linked? Will this just cause me/him more grief.We don't want the hassle of having to get premission everytime we have to leave and go to the states. It cost over $50 everytime to get it notorized.
